INDUSTRIAL DESIGN

    Requirements, Charges and Procedure in Malaysia
 


Requirements for filing industrial design applications in Malaysia are as follows:

  1. Full Name and Address of Applicant. For companies, have to stated country of incorporation, and nature of the company (e.g. private limited, public listed).
  2. Full Name and Address of Designer.
  3. Design details. Article to which the design is applied. Statement of novelty, provide the features of the design from which novelty is claimed (e.g. shape and configuration, pattern and ornament or a combination thereof).
  4. Locarno Classification of the article to which the design is applied, provide class and sub-class
  5. Representations of the article, provide two (2) sets of photographs or drawing of perspective, front, rear, top, bottom and side views, the size of each representation must not exceed 12.5 cm in length and 9 cm width.
  6. Date, Country and Application number of priority application (if priority is claimed).

Industrial Design Registration Procedure in Malaysia

APPLICATION REQUEST

Application examined to determine filing date.

     
 

Applicant must lodge

● ID Form 1, representations of the article, a statement of novelty and prescribed fees as required by Section 14 Industrial Designs Act 1996.
           
                 

DATE OF FILING AND NUMBER IS ASSIGNED

Date of filing is assigned upon submission of completed form, documents and filing fees as required by Section 16 Industrial Designs Act 1996.
 
FORMAL REQUIREMENTS & EXAMINATION

Duration:
6 months from the date of filing, to ensure no priority claim.

      
     

Applications are examined to ensure they met all formal requirements and are recommended for registration as required by Section 21 Industrial Designs Act 1996.

 
       
  ISSUANCE OF CERTIFICATE
 

Duration:
4 to 8 weeks

      
   

A certificate of registration is issued as required by Sub-section 22(1)(b) Industrial Designs Act 1996.

 
       
 

GAZETTING


Duration:
2 to 4 weeks

Upon approval, details / particulars of the registered design is sent for Government Gazette.
